Bombay High Court

JEEWAN DEVRAM SHIRSATHversusSTATE OF MAHARASHTRA

Decided

Holding

The petition for furlough leave was dismissed as moot because parole had already been granted.

Summary

The petitioner, Jeewan Devram Shirsath, filed a criminal writ petition seeking furlough leave from custody. The petitioner’s counsel informed the court that his mother was ill, prompting the respondent State to grant him parole for 40 days on 5 September 2026. The court observed that since parole had already been granted, there was no need to consider the furlough petition further. Consequently, the court declined to entertain the petition and ordered its disposal. The judgment also permitted the petitioner to pursue any appropriate remedy in the future if necessary.
