Since the petitioners' monetary claim was satisfied, the attachment and sale warrants were set aside and the writ petition was disposed.
Summary
The petitioners filed a writ petition in the Bombay High Court seeking a mandamus to enforce two recovery warrants issued under Section 40(1) of the Real Estate (Regulation and Development) Act, 2016, for a sum of Rs.52,84,570 and monthly compensation, by attaching the assets of Respondent No.6. Respondent No.6 later produced a demand draft of Rs.70,00,000 and a cheque of Rs.10,00,000, assuring payment. The court found that the petitioners' grievance was satisfied by this payment. Consequently, the court set aside the attachment and sale warrants and directed the petitioners to withdraw their pending RERA appeal. The writ petition was disposed, leaving the petitioners free to initiate further proceedings if necessary.
Issues considered
- Whether the High Court can compel execution of recovery warrants under Section 40(1) of the RERA Act through a writ of mandamus.
- Whether the attachment and sale warrants should remain in force after the respondent has satisfied the monetary claim.
- Whether the petitioners must withdraw their pending appeal before the RERA Appellate Tribunal.
