Bombay High Court

TUSHAR SATISH PATIL AND ANR.versusSTATE OF MAHARASHTRA AND ORS.

Disposal
Disposed Off

Holding

The petition is dismissed for default due to the petitioners' failure to appear.

Summary

The petitioners filed a writ petition challenging the reservation of a parcel of land for the construction of a high school and its playground. The petition sought relief against the reservation order. No counsel appeared on behalf of the petitioners when the matter was called on 22 September 2026 and again on 29 September 2026. The court noted that notice had been duly served to the petitioners. Since the petitioners failed to prosecute the case, the court dismissed the petition for default.

                                                     DATE : 29 SEPTEMBER 2026.
                      P. C. :

                      1. By the present Petition, the Petitioners have challenged the

reservation of the subject land for a high school and playground.

                      2. None appears for the Petitioners when the matter is called

out. Even on the earlier occasion, i.e. on 22 September 2026, none

appeared on behalf of the Petitioners.

                      3. The office remark shows that notice to Petitioner Nos. 1 and

2 has been duly served. It seems that the Petitioners are not interested

in prosecuting the matter any further.

                      4. Hence, the Petition stands dismissed for default.
