The petition was partly allowed, reducing the maintenance by Rs.5,000 and ordering a total payment of Rs.15,000 per month along with payment of arrears within three months.
Summary
The petitioner, who runs a gym, was paying Rs.20,000 as maintenance to his child and also Rs.10,000 in domestic violence (D.V.) proceedings. He sought a reduction of the maintenance to Rs.15,000, offering to pay the arrears if the reduction was granted. The respondent, a government employee, opposed the reduction, arguing that the child's educational and other expenses were high. The court considered the incomes of both parties, the existing D.V. payment, and the family court's order, and decided to reduce the maintenance by Rs.5,000, directing the petitioner to pay Rs.5,000 to the child and continue Rs.10,000 in D.V. proceedings, totaling Rs.15,000 per month. The court also ordered the petitioner to clear arrears within three months and disposed of all pending applications.
Issues considered
- Whether the maintenance amount payable by the petitioner can be reduced from Rs.20,000 to Rs.15,000.
- Whether the petitioner should be directed to pay arrears of maintenance within a specified period.
- Whether pending applications related to the maintenance dispute should be disposed of.
