Disposal
Disposed off as Withdrawn

Holding

The Court allowed the withdrawal of the writ petition, granted liberty to file a criminal revision under Section 438 of the BNSS, and excluded the time spent on the petition from limitation under Section 14 of the Limitation Act, 1963.

Summary

The petitioner filed a criminal writ petition seeking quash of an order dated 05.03.2021 passed by the JMFC, Solapur, and to discharge the accused in complaint SCC No. 2234 of 2020. The petitioner later sought to withdraw the petition and requested liberty to file a criminal revision under Section 438 of the Bharatiya Nagarik Suraksha Sanhita, 2023 before the Sessions Court, also asking that the time spent on the petition be excluded under Section 14 of the Limitation Act, 1963. The respondent State did not oppose the request. The Court granted leave to withdraw the petition with liberty to file the revision and ordered that the time spent be excluded for limitation purposes, noting the petitioner acted in good faith. All merits remain open for consideration in the forthcoming revision. The writ petition was disposed of as withdrawn.

Issues considered
