Summary

The petitioner, Janata Book Manufacturing Depot, filed a writ petition challenging a demolition notice issued by the Municipal Corporation of Greater Mumbai under Section 354 of the Mumbai Municipal Corporation Act, 1988, concerning its premises known as 'Beauty Art Dyers & Cleaners'. While the petition was pending, the building was demolished. The petitioner’s counsel then sought permission to withdraw the writ petition, stating that the petitioner could pursue any other legal remedy available under the statute. The respondents did not oppose this request. The Court allowed the withdrawal and disposed of the writ petition, granting the petitioner liberty to seek other remedies.
