The petition is allowed; the petitioners are entitled to the benefits of the old pension scheme and the respondents' exclusionary actions are illegal.
Summary
The petitioners, non‑teaching employees of a Maharashtra educational institution, were initially appointed on a temporary basis and later regularised with pay‑scales from 2004‑2008. They challenged a 25 June 2013 communication and the exclusion of their category from the Government Resolution dated 19 July 2011, seeking to be governed by the old pension scheme under the Maharashtra Civil Services (Pension) Rules, 1982 and related rules. The High Court relied on its earlier decisions in Anjali Shridhar Kulkarni v. Prakash Mishra and Nilesh S/o Namdev Gurav v. State of Maharashtra, finding the respondents’ actions illegal. The Court held that the petitioners are entitled to the benefits of the old pension scheme, ordered the refund of any deductions made under the new scheme, and directed the issuance of a General Provident Fund account. Consequently, the petition was allowed and the respondents were directed to implement the old pension provisions.
Issues considered
- Whether the communication dated 25 June 2013 issued by the respondent is illegal and bad in law.
- Whether the exclusion of non‑teaching employees from the applicability of the Government Resolution dated 19 July 2011 is illegal.
- Whether the petitioners are entitled to the benefits of the old pension scheme under the Maharashtra Civil Services (Pension) Rules, 1982 and related rules.
- Whether the respondents must refund deductions made under the new pension scheme and provide a GPF account.
