The Court may correct an obvious typographical error in its order, replacing the erroneous word with the correct one.

Summary

Petitioners filed a writ petition before the Bombay High Court, Circuit Bench, Kolhapur. In the minutes of order dated 17.08.2026, paragraph 15, second sentence incorrectly stated that the overt act was committed by the respondents instead of the petitioners and others. Respondent No.1’s counsel highlighted this obvious typographical mistake and sought a correction. The Court observed that the error was purely clerical and could be rectified under its inherent powers to correct mistakes in its orders. Accordingly, the Court ordered that the word “respondents” be replaced with “petitioners and others” and directed that the corrected copy be uploaded on the website. The motion for correction was disposed of.

                                                         DATE : 19th AUGUST, 2026.
                       P. C. :

. The motion is for speaking to the minutes of order dated

                       17.08.2026.

                       2. It is pointed out by learned counsel for respondent no.1 that in

paragraph no.15, second sentence, it has been recorded that overt act of

the respondents has already been castigated by the Appellate Court as

well as this Court. It is stated to be the overt act of the “petitioners and

                       others”.

                       3. The mistake is obvious and typographical and it needs correction.

                       4. In second sentence of paragraph no.15, the word “respondents”

shall be replaced by “petitioners and others”.

5. The corrected copy be uploaded on the website.
