The order dated 21 November 2022 is quashed and set aside, and the intervenor is to be impleaded in Application No. 175 of 2019.
Summary
The petitioner, Shekhar Pramod Kadam, filed a writ petition challenging the order dated 21 November 2022 passed by the Assistant Charity Commissioner, which rejected an intervenor's application to join Application No. 175 of 2019 pending before the Commissioner. The respondents, who are the original applicants before the Commissioner, conceded that the intervenor should be impleaded in the charity proceedings. The Bombay High Court, noting that the merits of the charity matter need not be examined, held that the Commissioner’s order was erroneous. Consequently, the Court quashed and set aside the impugned order and directed that the intervenor be impleaded in the pending application. The writ petition was thereafter disposed of.
