Bombay High Court

SAHIL FIROZ ANSARIversusSTATE OF MAHARASHTRA AND ORS

Decided
Disposal
Disposed Off

Holding

The petition was dismissed because the statutory period of detention had expired and the petitioner was already released, leaving no surviving claim.

Summary

The petitioner, Sahil Firoz Ansari, filed a writ petition challenging a detention order dated 08/06/2026. He argued that a detention confirmation order dated 21/07/2026 limited his detention to 90 days from the date of arrest, which had already elapsed. The petitioner further stated that he had been released and that there was nothing left to claim in the petition. The court recorded and accepted the statement of the petitioner. Noting that the statutory period of detention had expired and the petitioner was no longer in custody, the court found no remaining issue to adjudicate. Consequently, the petition was disposed of as not pressed.

Issues considered

  • Whether the detention beyond the statutory period of 90 days is unlawful and can be challenged.
  • Whether a writ petition can be entertained when the petitioner has already been released and no relief remains.

                                           DATE : 01st OCTOBER, 2026

                        P.C. :

                        1. The Petitioner has challenged the Detention Order

dated 08/06/2026. Learned counsel for the Petitioner submitted

that on 23/07/2026 the Detention Confirmation Order was

served on him. It is dated 21/07/2026, which mentions that the

detention was restricted upto 90 days from the date of

detention. He submitted that he was detained on 08/06/2026

and therefore the period of 90 days is over. The Petitioner is

already released. He states that nothing survives in this Petition.

                        2. The statement is recorded and accepted.
