Disposal
DISPOSED OFF

Holding

The writ petition is dismissed for want of prosecution.

Summary

The petitioner filed a writ petition under Article 226 seeking relief from an execution petition filed under Order XXI Rule 97 of the Code of Civil Procedure, which had been rejected by the executing court. The High Court stayed the execution proceedings on 23 March 2022, but the writ petition was not listed for a long period. The petitioner failed to appear on multiple dates, including 2 September 2026, 23 September 2026, and the date of the hearing. The Court inferred that the petitioner was not interested in prosecuting the writ petition and dismissed it for want of prosecution. The Court directed the executing court to complete the execution of the decree dated 6 December 2000 before 31 December 2026.

                                     DATE : 30TH SEPTEMBER, 2026.

                 ORDER :

. The present petition arising out of proceedings of
application filed U/O XXI Rule 97 of the Code of Civil Procedure
by the petitioner, which came to be rejected by the learned

                 2. While issuing notice vide order dated 23.03.2022 further
proceedings in execution petition were stayed by this Court. The
