Holding

The petition is allowed subject to the parties depositing Rs.10,000 with the library.

Summary

The petitioners, Natha Kabhu Sonnar and others, filed a criminal writ petition against the State of Maharashtra. The petitioners and the informant/victim reached a voluntary settlement and jointly requested the court to allow the petition, offering to deposit Rs.10,000 to the High Court Bar Association Library. The respondent (APP) opposed any relief, citing the nature of the offence. The court found no justification to deny the petition given the settlement and allowed it subject to the stipulated deposit. Consequently, the petition was granted in accordance with prayer clauses B and B1, conditional upon the Rs.10,000 payment within two weeks.
