The Court held that the Deputy Director of Education must decide the pending appointment proposal within four weeks, considering the superseding Government Resolution.
Summary
The petitioner, Tushar Shivaji Adamapure, filed a writ petition seeking a direction to the Deputy Director of Education to decide a proposal dated 16‑12‑2024 for his appointment as Laboratory Assistant at a junior college. The petitioner argued that the decision was stalled due to a communication dated 28‑05‑2025 from the Director of Education, which had been superseded by a Government Resolution dated 11‑08‑2026. The High Court noted the undue delay and ordered the Deputy Director to decide the proposal within four weeks, taking due note of the superseding resolution. The Court further directed that, if approval is granted, the petitioner’s name be entered in the Shalarth Pranali and a Shalarth ID issued within three weeks, with the grant‑in‑aid salary released within four weeks thereafter. The petition was allowed in these terms.
Issues considered
- Whether the Deputy Director of Education should be compelled to decide the pending appointment proposal despite the earlier communication being superseded by a later Government Resolution
- Whether the petitioner is entitled to inclusion in the Shalarth Pranali and issuance of a Shalarth ID upon approval of the appointment
