BEBI ASHA NAIMODDIN SHAIKHversusTHE DIVISIONAL TRAFFICE SUPERINTENDENT AND ANOTHER

Disposal
DISPOSED OFF

Holding

The writ petition is disposed of in view of the parties' compromise.

Summary

The petitioner, a conductor employed by the respondents, received a show‑cause notice for dismissal and challenged it before the Labour Court, which dismissed the case. He then filed a revision before the Industrial Court, which also dismissed the matter. Subsequently, the petitioner filed a writ petition in the High Court. The parties later entered into a compromise dated 17‑03‑2026, wherein the respondents agreed to impose a punishment of stopping three yearly increments permanently from the date of the final show‑cause notice (12‑04‑2012) instead of dismissal. Both sides submitted that, in view of this compromise, the petition should be disposed of. The Court accepted the compromise and disposed of the writ petition.
