The Court held that the Scrutiny Committee must issue the validity certificate to the petitioner as belonging to the ‘Koli Mahadev’ Scheduled Tribe.

Summary

The petitioner, a 19‑year‑old engineering student, sought a direction to the Schedule Tribe Certificate Scrutiny Committee to issue her a validity certificate confirming her belonging to the ‘Koli Mahadev’ Scheduled Tribe. She already possessed a caste certificate issued by the competent authority, but the Scrutiny Committee had not yet decided on her claim. The petitioner relied on a prior judgment (Writ Petition No. 4340 of 2026) in which the Court set aside the Committee’s order invalidating her brother’s tribe claim and directed issuance of a validity certificate to him. The Court observed that, under the settled principle that a blood relative holding a valid caste/tribe certificate entitles other blood relatives to the same status, the petitioner was likewise entitled to a certificate. Consequently, the Court allowed the writ petition and ordered the Scrutiny Committee to issue the validity certificate to the petitioner by a specified date, and thereafter disposed of the petition.

Issues considered

  • Whether the Scrutiny Committee must issue a validity certificate to the petitioner for the ‘Koli Mahadev’ Scheduled Tribe based on her brother’s validated certificate.
  • Whether the principle that a blood relative’s valid caste/tribe certificate extends to other blood relatives applies in this case.

dispute that this Court in the aforesaid writ petition set aside the order

of invalidation of the tribe claim of the Petitioner’s brother and submit

6. In the said writ petition, which is on today’s board, the order

impugned was dated 28th August 2026 passed by the Scrutiny

Committee invalidating the tribe claim as belonging to the ‘Koli

Mahadev’ of the Petitioner’s brother is set aside. The tribe claim of the

Petitioner’s brother was also referred to the Scrutiny Committee and

the Scrutiny Committee had directed vigilance inquiry and had

invalidated his claim. This Court, on going through the record, found

                        8. Thus, in the backdrop of the above observations, we allow the
