Disposal
DISPOSED OFF

Holding

The writ petition is allowed; the communication dated 15‑05‑2026 is quashed and the Deputy Director must reconsider the proposal without relying on the earlier letter.

Summary

The petitioners, Somnath Dattatraya Malnath and another, challenged a communication dated 15 May 2026 issued by the Deputy Director of Education of Maharashtra, arguing that it was improperly based on a letter dated 28 May 2025 from the Director of Education. The High Court, referring to its earlier judgments in Writ Petition Nos. 381/2026 and 257/2026, held that the communication was unlawful and quashed it. The Court directed the Deputy Director to reconsider the petitioners' proposal without relying on the earlier letter. The matter was to be decided on its merits within six weeks of receipt of the order. Consequently, the writ petition was allowed and the state’s administrative action set aside.

Issues considered

  • Whether the communication dated 15‑05‑2026 issued by the Deputy Director of Education is legally valid.
