Bombay High Court

AMIT DHANAJI MEPANIversusTHE STATE OF MAHARASHTRA AND ANR

Decided
Disposal
Disposed Off

Holding

The writ petition is dismissed for non‑prosecution.

Summary

The petitioner Amit Dhanaji Mepani filed a writ petition in 2024 challenging an order dated 08.01.2019 passed by the Additional Sessions Judge, Mumbai. The petition sought relief against that order but, after filing, neither the petitioner nor his counsel took any steps to advance the case. The court observed that there was no effort to circulate the matter or to seek the reliefs prayed for. It inferred that the petitioner was not desirous of seriously prosecuting the writ petition. Consequently, the High Court dismissed the writ petition for non‑prosecution.

                                                   DATE : 18th SEPTEMBER, 2026

                       P.C:-

                       1. Although the Writ Petition which was filed in the year

2024 seeks to assail the order dated 08.01.2019 passed by the

Additional Sessions Judge, Mumbai, since the institution of the

Writ Petition, no efforts seems to have been made by either the

counsel for the Petitioner or the Petitioner to circulate the

matter or to seek any reliefs prayed for therein. It is evident

from the conduct of the Petitioner that he is not desirous of

                       seriously prosecuting the Writ Petition.

Consequently, the Writ Petition stands dismissed for non-

                       prosecution.

                                                                (ASHISH S. CHAVAN, J.)
