Bombay High Court

THE COMMISSIONER, KOLHAPUR MUNICIPAL CORPORATION , KOLHAPURversusTHE STATE OF MAHARASHTRA, THR REVENUE AND FOREST DEPT. AND ORS

Disposal
Dismissed

Holding

The Court held that the obvious typographical mistake must be corrected and the corrected copy uploaded.

Summary

The petitioners, the Commissioner of Kolhapur Municipal Corporation and Dilip Ashok Desai, filed writ petitions seeking correction of typographical errors in the minutes of judgment dated 24 September 2026. The error concerned the recorded date of a decision by the Sub‑Divisional Officer, which was printed as 03.12.2019 instead of the correct 03.12.2009. The Court examined whether such a clerical mistake could be rectified without a fresh hearing. Finding the mistake obvious and purely typographical, the Court ordered that the date be corrected in both instances and that the corrected copy be uploaded. The motion for correction was therefore disposed of.

P.C. :

The motion is made for speaking to the minutes of judgment

2. My attention is adverted to the typographical mistakes regarding

the year of the decision rendered by the Sub-Divisional Officer. In

paragraph No. 2 and Sr. No. 5 of paragraph No. 4 of the order dated

24.09.2026, the date of the decision is recorded as “03.12.2019”. It

3. The mistake is obvious and typographical in nature and,

therefore, requires correction at both the places. Accordingly, the date

4. Necessary corrections be carried out and the corrected copy be
