Bombay High Court

KETAN JITENDRABHAI PATELversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The High Court held that it may order the prompt disposal of a pending bail application to protect the petitioner’s liberty.

Summary

The petitioner, Ketan Jitendrabhai Patel, filed a writ petition in the Bombay High Court seeking speedy disposal of his bail application pending before the Metropolitan Magistrate Court. He had been in custody since 31 March 2026, and his bail application filed in June 2026 remained unresolved for over two months. The petitioner argued that the delay violated his right to liberty and sought a court directive for expeditious consideration. The respondent State, through its APP, did not contest the request for speedier handling. Justice Shivkumar Dige, after hearing both sides and reviewing the record, ordered that the petition be allowed and directed the magistrate to decide the bail application within two weeks, effectively disposing of the petition.
