Bombay High Court

ADARSH EDUCATION SOCIETY THROUGH ITS PRESIDENT AND ANOTHERversusTHE STATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court held that the petition cannot be entertained for the elapsed academic year but permitted the petitioner to file a fresh proposal for the current academic year.

Summary

The petitioner, Adarsh Education Society, filed a writ petition challenging the State of Maharashtra’s rejection of its proposal for the 2024‑25 academic year on the ground that its NAAC accreditation had expired on 4‑Nov‑2021. The petitioner argued that it had already obtained a B+ grade NAAC accreditation and that the authorities had not considered this. The Court noted that the academic year 2024‑25 had already passed and the subsequent year 2025‑26 was underway. Consequently, the Court declined to order admission for the earlier year but allowed the petitioner to submit a fresh proposal for the current academic year. The petition was therefore disposed of without granting the relief sought for 2024‑25.

Issues considered

  • What is the legal effect of the expiry of NAAC accreditation on a college’s proposal for admission of students for a given academic year?
  • Whether the petitioner is entitled to relief for the 2024‑25 academic year despite the alleged lapse of accreditation.
