Bombay High Court
RAMESHWAR GUMANRAO SARODEversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISMISSED
Holding
The petition is dismissed for non‑prosecution.
Summary
The petitioner, Rameshwar Gumanrao Sarode, filed a criminal writ petition seeking a direction to register a crime against respondents No. 4 and 5 under IPC Sections 420, 463, 465, 466 and 471. The court observed that the petitioner had not taken any steps to circulate the petition or pursue prosecution after filing it. Consequently, the court inferred a lack of interest on the part of the petitioner to prosecute the matter. The petition was therefore dismissed for non‑prosecution. No substantive merits of the alleged offences were examined.
Issues considered
- Whether the court should issue a direction to register an FIR against respondents No. 4 and 5 when the petitioner shows no interest in prosecuting the matter.
