Holding
The Court disposed of the writ petition without addressing its merits, directing the BMC to complete the pending proceedings within three months.
Summary
Mrs. Shamim Bhayani Karwa filed a writ petition alleging that Respondent No.5 carried out unauthorized structural alterations and that the Brihanmumbai Municipal Corporation (BMC) issued a show‑cause notice under Section 351(1A) of the Mumbai Municipal Corporation Act, 1888. The petitioner sought a court order directing the BMC and other respondents to expedite the complaints dated 3 February, 15 April and 20 May 2026 and to file a compliance report. The Court, after hearing counsel, declined to issue notice to the respondents or to rule on the merits of the complaints. It observed that the BMC had already taken cognizance by issuing the show‑cause notice and therefore should complete the proceedings within three months, giving all parties a hearing. Consequently, the petition was disposed of without adverting to the substantive issues.
Issues considered
- Whether the Court should intervene and issue notice to the BMC and other respondents in the petition.
- Whether the Court should direct the BMC to expedite the demolition proceedings arising from the alleged unauthorized construction.
- Whether the merits of the complaints and the show‑cause notice need to be examined by the Court.
