Bombay High Court
HUSSAIN ABBASALI KHANversusTHE STATE OF MAHARASHTRA, THRU THE GOV. PLEADER
- Decided
- Disposal
- DISPOSED OFF
Holding
The Court ordered the municipal authority to decide the pending complaints within eight weeks, without issuing a notice or adjudicating the merits.
Summary
The petitioner filed a writ petition seeking a mandamus directing the municipal authorities (Respondents Nos. 2 and 3) to consider two complaints dated 23 January 2026 and 9 February 2026 and to promptly initiate demolition of an unauthorized first‑floor construction at Siddiuge Mohammad Chawl, Mumbai. The petitioner alleged that the construction violated building regulations and demanded immediate action. The respondents argued that the complaints were recent and required time to ascertain their status. The Court declined to issue a notice or stay the petition, directing the competent authority to decide the complaints within eight weeks of the order, after giving a hearing to all stakeholders, without addressing the merits. Consequently, the petition was disposed of without prejudice to the parties' contentions.
Issues considered
- Whether the municipal authority is duty-bound to act on the complaints alleging illegal construction.
- Whether a writ of mandamus is appropriate to compel the authority to take demolition action.
- Whether the Court should issue notice or stay the petition pending consideration of the complaints.
Subjects
- writ of mandamus
- municipal corporation
- illegal construction
- demolition order
- statutory duty
- public interest litigation
