PRARTHANA DEEPAK NAIKversusTHE STATE OF GOA THR CHIEF SECRETARY AND ANR

Disposal
Withdrawn

Holding

The petition is disposed of as withdrawn, with liberty granted to approach the appropriate authority.

Summary

The petitioner, Prarthana Deepak Naik, filed a writ petition challenging disciplinary proceedings against her. The respondents, the State of Goa and the Chief Secretary, informed the court that an effective remedy exists before the Secretary of the Education Department, and that a similar case involving another teacher was also pending before that authority. The petitioner’s counsel sought permission to withdraw the petition and pursue the matter before the appropriate administrative authority. The court granted permission to withdraw, emphasizing that it had not examined the merits and that all contentions remain open for adjudication before the concerned authority. Consequently, the petition was disposed of as withdrawn.

           P.C.:

           1. At the outset, Mr Prashil Arolkar, learned Counsel appearing
for the Respondents, has brought to my notice that there is an
efficacious remedy available before the Secretary of the Education
Department. In fact, he says that the other teacher, who was also
proceeded against and subjected to disciplinary action, has also
approached the Secretary, Education Department. Hence, it will be
in the interest of justice if the proceedings initiated against both the
           teachers are heard together.

           2. Ms Kalokhe, learned Counsel appearing for the Petitioner,
seeks permission to withdraw the present petition and approach the
