Decided

Holding

Dismissed writ petitions may be restored and disposed of upon the parties’ amicable settlement and filing of consent terms.

Summary

Kash Foods Pvt Ltd filed several writ petitions challenging an office order that dismissed the petitions for failure to remove objections. The High Court observed that the parties subsequently reached an amicable settlement and filed consent terms. The court took the consent terms on record, marked them for identification, and restored the dismissed writ petitions. Accordingly, the court disposed of all the writ petitions in view of the settlement. The court also permitted the filing of a vakalatnama on behalf of Respondent No. 2 within two weeks.

Issues considered

  • Whether a writ petition dismissed for non‑removal of office objections can be restored.
  • Whether an amicable settlement and consent terms justify disposal of the writ petitions.
  • Whether the respondent may be allowed to file a vakalatnama after the order.
