The court restored the dismissed writ petitions and disposed of them on the basis of the parties' consent settlement.

Summary

The petitioners, Kash Foods Pvt Ltd, filed multiple writ petitions challenging an office order that dismissed their petitions for failure to remove objections. The respondents, including the Assistant Registrar C.S. SRA Mumbai, contended that the procedural requirements were not complied with. The parties subsequently reached an amicable settlement and filed consent terms in each petition. The High Court, after noting the consent terms, restored the two writ petitions (Nos. 50 of 2026 and 193 of 2026) that had been dismissed. The Court then disposed of all the writ petitions on the basis of the settlement. It also directed that the vakalatnama for Respondent No.2 may be filed within two weeks. No substantive questions of law were adjudicated beyond the procedural restoration.

Issues considered

  • Whether the dismissal of the writ petitions for non‑removal of office objections can be set aside
  • Whether the court may entertain consent terms and dispose of the petitions on the basis of an amicable settlement
  • Whether a vakalatnama may be filed after the petitions have been disposed
