Bombay High Court

ARYADEEP INVESTMENT AND HOLDING PRIVATE LIMITED, THROUGH ITS DIRECTOR ANTONIO TRINDADEversusMUNICIPAL CORPORATION OF GREATER MUMBAI

Decided
Disposal
DISPOSED OFF

Holding

The Court held that it would not entertain the petition for mandamus and instead directed the petitioners to re‑file a fresh application for consideration.

Summary

The petitioners, Aryadeep Investment and Holding Private Limited & Anr., filed a writ petition seeking a mandamus directing the Municipal Corporation of Greater Mumbai (BMC) and its competent authority to process a written complaint dated 21 October 2024 and to take action under the MMC Act and MRTP Act. The petitioners alleged that the complaint had not been considered, while the respondents contended that the complaint was vague and that Respondent No. 3 was a bona‑fide purchaser under the SARFAESI Act. The Court declined to examine the merits of the complaint, noting the procedural deficiencies. It ordered the petitioners to file a fresh application with all relevant documents within two weeks and directed the competent authority to decide the matter within three months after hearing all stakeholders. Consequently, the writ petition was disposed without granting the relief sought.

Issues considered

  • Whether the High Court should issue a writ of mandamus directing the Municipal Corporation to process the petitioners' complaint.
  • Whether the complaint filed on 21 October 2024 is maintainable and substantive.
  • Whether the status of Respondent No. 3 as a bona‑fide purchaser under the SARFAESI Act bars the municipal authority from taking action.
