Bombay High Court

PARSHURAM LAXMAN GURAVversusSTATE OF MAHARASHTRA THR. THE PRINCIPAL SECRETARY HEALTH DEPT. AND ORS.

Disposal
Disposed Off

Holding

The Court ordered the concerned government authority to decide the petitioner's promotion representation within four weeks, thereby disposing of the petition with directions.

Summary

The petitioner, Parshuram Laxman Gurav, filed a writ petition challenging the failure of Respondent No.3 to consider his representation seeking promotion, which was forwarded on 22 April 2026. The respondent State, through its Additional Government Pleader, argued that the promotion proposal could not be accepted under applicable Government Resolutions, and therefore no written communication was sent to the petitioner. The Court noted the absence of any communication to the petitioner and directed Respondent No.3 to decide the representation expeditiously, within four weeks from the date of the order. No substantive merits of the promotion request were examined. The petition was disposed of with a directive for prompt administrative action.

P. C. :

1. The limited grievance in the present petition is as regards non

consideration of Petitioner’s representation seeking promotion, which

has been forwarded to Respondent No.3 on 22nd April 2026.

2. Learned AGP, on instructions, would submit that proposal cannot

be accepted as per the applicable Government Resolutions. In such an

event, it was expected that Respondent No.3 would communicate the

said decision to the Petitioner so that the Petitioner can take further

steps in the matter. As there is no written communication to the

Petitioner, the petition is disposed of by directing the Respondent

No.3 to decide the Petitioner’s said representation as expeditiously as

possible and in any event within a period of four weeks from today.
