- Disposal
- Transfer to other court
Holding
The Court permitted the petitioners to amend their writ petitions to challenge Section 147-A and ordered the transfer of those matters to the Principal Seat for a consolidated hearing.
Summary
The Bombay High Court, Aurangabad Bench, listed a large number of writ petitions for hearing in compliance with a Supreme Court judgment dated 10 April 2026 in Income Tax Officer, Ward2(1), Chandigarh vs. Tej Pratap Singh. The petitioners sought to challenge the constitutional validity of Section 147-A of the Income Tax Act. The Court directed the petitioners to file amendments to their writ petitions within one week, specifically to raise the challenge to Section 147-A. It ordered that all matters where such amendments are filed be transferred immediately to the Principal Seat for consolidated hearing on 31 August 2026. The Court also identified certain writ petitions that were not on the board and directed their transfer to the Principal Seat. Failure to amend within the stipulated time would result in a mandatory amendment after transfer. The order is procedural, allowing amendment and transfer but does not decide the substantive issue of Section 147-A's validity.
