Holding

The Court ordered that the two writ petitions be transferred to the Principal Seat on the Original Side for consolidated hearing with Writ Petition No. 1749 of 1999.

Summary

USV Limited filed Writ Petition Nos. 3031 and 5219 of 1996 in the Kolhapur Circuit Bench of the Bombay High Court. The petitioners argued that the questions raised were identical to those in Writ Petition No. 1749 of 1999, which was pending before the Principal Seat on the Original Side. They therefore prayed for the two petitions to be transferred to the Principal Seat for a consolidated hearing. The Court agreed that the matters were substantially the same and that transfer would promote judicial economy. Accordingly, the Registry was directed to transfer both petitions to the Principal Seat on the Original Side to be heard together with Writ Petition No. 1749 of 1999 and related matters.
