Bombay High Court

BASUDEO MATOLIRAM AGRAWALversusTHE STATE OF MAHARASHTRA

Disposal
DISPOSED OFF

Holding

The High Court declined to direct the Judicial Magistrate to dispose of the case within a stipulated time, citing heavy pendency.

Summary

The petitioner, Basudeo Matoliram Agrawal, filed a criminal writ petition seeking a direction for the expeditious disposal of RCC No. 279 of 2023 pending before the Judicial Magistrate (First Class) in Basmat, Hingoli. The petition argued that the case was suffering from undue delay. The Court examined whether it could intervene and impose a time frame on the magistrate given the existing heavy pendency of cases. The judges noted the substantial backlog before the magistrate and expressed reluctance to interfere at this stage. Consequently, the Court declined to grant any relief or impose a deadline. The petition was therefore disposed without any order directing the magistrate.

          2. Learned counsel for the petitioners seeks a direction for
expeditious disposal of R.C.C. No. 279 of 2023, pending before the
learned Judicial Magistrate (First Class), Court No. 1, Basmat, District
          Hingoli.
          3. However, considering the heavy pendency of cases before the
learned Judicial Magistrate (First Class), we are not inclined, at this
stage, to grant any relief in favour of the petitioners or to direct the
concerned Judicial Magistrate (First Class), Basmat to decide the case
within a stipulated time frame. Accordingly, the petition stands
          disposed of.
