The High Court may correct a clerical error in its own order without affecting the substantive relief granted.
Summary
The petitioner filed a criminal writ petition seeking correction of a clerical error in the bail order dated 4th March 2026, where the name of Respondent No.3 was incorrectly recorded as ‘Mr. Hatumal M. Sharma’ instead of ‘Mr. Nathumal M. Sharma’. The issue before the Court was whether it could amend its own order to rectify such a mistake. The Court examined the petition and found that the error was purely typographical and did not affect the substantive rights of the parties. Accordingly, the Court ordered that the name be corrected in the minutes of the order. The precipe was then disposed of after the correction was made.
