Disposal
DISPOSED OFF

Holding

The High Court set aside the University & College Tribunal’s contempt order.

Summary

The petitioners, President of Mahatma Gandhi Taluka Shikshan Mandal and others, challenged a contempt order passed by the University & College Tribunal, Aurangabad, which had found them guilty under Section 63 of the Maharashtra Universities Act, 1994 for not complying with an interim order and imposed a fine of Rs 1,000 each. The petitioners argued that the interim grievance had become moot because the main appeal before the Tribunal was finally disposed of, and they demonstrated compliance by depositing the fine amount, as evidenced by a receipt. The High Court, noting the petitioners’ compliance and the changed circumstances, decided to give a quietus to the dispute. Consequently, the Court set aside the Tribunal’s judgment and order dated 16 September 1999. The writ petition was therefore disposed of without any order as to costs.

Issues considered

  • Whether the contempt order under Section 63 of the Maharashtra Universities Act, 1994 should stand despite the petitioners’ subsequent compliance and deposit of the fine.

                                     CORAM : SACHIN S. DESHMUKH, J.
                                     DATE : 9th SEPTEMBER, 2026

            PER COURT :

            1. Heard Mr. B. R. Warma, learned counsel for the petitioners.

            2. By this petition, the petitioners have challenged the judgment
and order dated 16/09/1999 rendered by the Presiding Officer, University &
College Tribunal, Aurangabad, in Miscellaneous Application No. 7/1999. By
the impugned order, the learned Tribunal had held the petitioners guilty of
contempt under Section 63 of the Maharashtra Universities Act, 1994, for
non-compliance with an interim order and sentenced to pay a fine of Rs.
            1,000/- each.

            3. Mr. Warma, the learned counsel for the petitioners, submits that
the interim grievance has worked out itself since the main appeal before the
Tribunal already stands finally disposed of. The learned counsel further
                                                          W.P.No.5518/1999
                                   :: 2 ::

submitted that to show bona fides, the petitioners have complied with the
directions of this Court by depositing the requisite amount. The learned
counsel has placed on record a receipt indicating the deposit of Rs. 1,000/-.
The said receipt is taken on record.

4. In view of the compliance made by the petitioners and the
subsequent development, this Court deems it appropriate to give a quietus to
the dispute. Consequently, the impugned judgment and order dated
16/09/1999 rendered by the University & College Tribunal, Aurangabad in
Misc. Application No. 7/1999 is set aside.

5. The Writ Petition stands disposed of accordingly. No order as to
costs.
