Bombay High Court

MANISHA SATISH BHAPKARversusTHE ADDITIONAL SUPERINTENDENT OF POLICE (GADHINGLAJ) AND ORS.

Holding

The Court ordered the petitioner to submit the appeal copy and directed the State to decide the pending 2020 appeal expeditiously, thereby disposing the writ petition.

Summary

Manisha Satish Bhapkar filed a writ petition seeking a direction to the State (Respondent No.3) to decide an appeal that has been pending since 2020. The Additional Superintendent of Police and others were impleaded as respondents. The learned Additional Government Pleader argued that the appeal record annexed to the petition was not traceable and lacked a registration number or departmental seal, casting doubt on its existence. The Court directed the petitioner to furnish a copy of the appeal if the proceedings could not be located with the State Government. It also instructed Respondent No.3 to decide the pending appeal expeditiously given its age. The writ petition was thereafter disposed of on these terms.

Issues considered

  • What procedural direction can the High Court issue to a State authority to ensure a pending appeal is decided?
  • Does the absence of a registration number or departmental seal on an annexed document preclude the existence of a pending appeal?
