Bombay High Court

MATHURA RAJU PAWARversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The writ petition is infructuous and is therefore disposed of.

Summary

The petitioner, Mathura Raju Pawar, was elected as a member and subsequently as Sarpanch of the Dughala Village Panchayat in the 2021 elections. She later faced a no‑confidence motion which was decided against her at both the Gram Panchayat and the higher authority. She filed a writ petition (902 WR 6021 of 2023) challenging those decisions. The Court observed that the tenure of the local body had already expired, rendering the petition moot. Consequently, the Court held the petition infructuous and disposed of it.

IN THE HIGH COURT OF JUDICATURE AT BOMBAY
                                 BENCH AT AURANGABAD
                             902 WRIT PETITION NO. 6021 OF 2023
                                         Mathura Raju Pawar
                                               VERSUS
The State Of Maharashtra And Others

                                               ----
            Mr.S.S.Londhe, Advocate for petitioner
            Mr.K.B.jadhavar, AGP for respondent nos.1 to 3
                                               ----

                                        CORAM : AJIT B. KADETHANKAR, J.
                                        DATE : AUGUST 29, 2026
            ORDER :-

The petitioner was elected as a Member of Village
Panchayat, Village : Dughala, Tq. Aundha-Nagnath, Hingoli in the
general elections in 2021. She was later elected as Sarpanch.
However, the petitioner had to face no confidence motion by the Gram
Panchayat members. The petitioner suffered the no-confidence motion
and hence the proceedings were taken up before the appropriate
authority. On both levels, the petitioner lost and therefore, the present
            petition is filed.

            2. It is apparent that by efflux of time, the Writ Petition has
become infructuous since the tenure of the local body is over. In view
thereof, the Writ Petition stands disposed of accordingly.

                                                [AJIT B. KADETHANKAR, J.]
                                              ………..
