Bombay High Court
SATISH MADHAVRAO PINGLEversusTHE STATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The petitions are not dismissed as premature; the corporation must consider the petitioners' reply on its merits within two weeks and any adverse decision is stayed for two weeks.
Summary
The petitioners challenged notices dated 17 June 2026 issued by a municipal corporation under Section 260 of the Maharashtra Municipal Corporations Act, 1949. The corporation argued that the petitions were premature because the petitioners had filed a reply on 25 June 2026 and the corporation had not yet decided on that reply. The petitioners approached the High Court on 29 June 2026, before the corporation’s decision. The Court held that the corporation must consider the petitioners’ reply on its own merits within two weeks and, if it decides against them, that decision cannot be acted upon for another two weeks. Accordingly, the writ petitions were disposed of with directions to the corporation to follow the stipulated timeline.
