Bombay High Court

SANDEEP DNYANOBA MUNDEversusTHE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND ANR

Disposal
DISPOSED OFF

Holding

The Court upheld the earlier decision of the Principal Seat in Writ Petition No. 8809 of 2026 and dismissed the present writ petitions.

Summary

The petitioners Sandip Dnyanoba Munde and others filed writ petitions (Nos. 6891, 7471, 7758 of 2026) in the Bombay High Court, Aurangabad Bench, challenging a governmental action. The respondents, the State of Maharashtra and others, opposed the petitions. The Court observed that the same issue had already been decided by the Principal Seat in Writ Petition No. 8809 of 2026, where the challenge was rejected. The petitioners relied on the decision in Tej Prakash Pathak & Ors. v. Rajasthan High Court (2025 (2) SCC 1), but the Aurangabad Bench noted that this case had already been considered in the earlier principal‑seat order. Consequently, the Bench found no merit in the petitioners' contentions and dismissed all the writ petitions. The dismissal was based on the principle of stare decisis, giving effect to the earlier detailed order of the Principal Seat.

Issues considered

  • The validity of the petitioners' challenge to the governmental action in light of the earlier decision in Writ Petition No. 8809 of 2026
  • Whether the judgment in Tej Prakash Pathak & Ors. v. Rajasthan High Court is applicable to the present petitions

Coordinate Bench at the Principal Seat.

2. Learned Advocate for the Petitioner in Writ Petition No.

7471 of 2026, in support of his submissions, has placed reliance

on “Tej Prakash Pathak and Others V/s Rajasthan High Court and

Others” 2025 (2) SCC 1. It is pertinent to note here that in the

decision rendered at the Principal Seat, the said judgment is

already considered in paragraph No.11. We, therefore, find no

merit in the contention raised by the Petitioner.

3. For the reasons stated in the said order, the Writ Petitions

are dismissed.
