The court held that the petitioner’s appointment to the fully aided post must be approved as directed, and allowed the amendment to implead the Deputy Director of Education to consider the proposal.
Summary
The petitioner, appointed as an Assistant Teacher in 2011 to an unaided post that later became fully aided, challenged a 2024 advertisement for the same post. The High Court previously quashed the advertisement and directed the Education Officer to approve her appointment within 45 days. The respondents later submitted a proposal to include the petitioner in the Shalarth Pranali and sought approval from the Deputy Director of Education. The Court granted leave to amend the petition to implead the Deputy Director, ordered the school to forward the proposal within two weeks, and directed the Deputy Director to consider it within four weeks after a hearing. The writ petition was disposed of without costs.
Issues considered
- Whether the advertisement for the Assistant Teacher post violated the petitioner's right to appointment after the post was converted to a fully aided position.
- Whether the court can direct the Education Officer to approve the petitioner's appointment and include her in the Shalarth Pranali.
- Whether amendment to implead the Deputy Director of Education as a respondent is permissible.
