The court quashed the pending domestic violence proceedings on the basis of the parties' settlement and Consent Terms.

Summary

The petitioners, senior citizen Hansaben Maniar and her relatives, sought to quash a domestic violence case (C.C. No.159/DV/2022) filed under the Protection of Women from Domestic Violence Act, 2005, pending before the Metropolitan Magistrate, Andheri. The respondents, including the State of Maharashtra and Ms. Chintal Mehta (widow of the deceased), consented to settle the dispute and executed Consent Terms, which were signed by all parties and their advocates. The court accepted the Consent Terms as valid undertakings and, relying on clause 3.4(i) of the terms, ordered the quashing of the pending proceedings. The keys to the subject premises were handed over by the respondent to the petitioners, indicating compliance with the settlement. Consequently, the writ petition was disposed of without any order as to costs.
