Bombay High Court

SATISH SHIVAJI BHENDEKARversusTHE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND ANOTHER

Disposal
DISPOSED OFF

Holding

The Court held that the issues raised are already decided by the principal seat in Writ Petition No. 8809 of 2026 and therefore the petitions must be dismissed.

Summary

Petitioner Sandip Dnyanoba Munde filed writ petitions (Nos. 6891, 7471 and 7758 of 2026) challenging a governmental action. The Court observed that the same challenge had already been decided by the Principal Seat in Writ Petition No. 8809 of 2026. The petitioner’s reliance on the decision in Tej Prakash Pathak & Others v. Rajasthan High Court (2025 (2) SCC 1) was noted, but the Court pointed out that this case had already been considered in the earlier principal‑seat order. Since the earlier order fully covered the issues raised, the Court found no merit in the present petitions. Consequently, the writ petitions were dismissed.

Issues considered

  • Whether the challenge raised in the writ petitions is maintainable in view of the decision in Writ Petition No. 8809 of 2026?
  • Whether the judgment in Tej Prakash Pathak & Others v. Rajasthan High Court (2025 (2) SCC 1) provides a basis to revive the challenge?

Coordinate Bench at the Principal Seat.

2. Learned Advocate for the Petitioner in Writ Petition No.

7471 of 2026, in support of his submissions, has placed reliance

on “Tej Prakash Pathak and Others V/s Rajasthan High Court and

Others” 2025 (2) SCC 1. It is pertinent to note here that in the

decision rendered at the Principal Seat, the said judgment is

already considered in paragraph No.11. We, therefore, find no

merit in the contention raised by the Petitioner.

3. For the reasons stated in the said order, the Writ Petitions

are dismissed.
