SURAJBAI MADANLAL INDANIversusVINOD GOPIKISHAN CHICHANI

Disposal
DISPOSED OFF

Holding

The writ petition is dismissed for want of prosecution.

Summary

The petitioner filed a writ petition in 2014 seeking relief against the respondent. No counsel appeared on behalf of the petitioner when the matter was called out. The court noted that the petition had been pending for over a decade despite ample opportunities being given to the petitioner to prosecute the case. Consequently, the court held that there was no justification for further delay and dismissed the petition for want of prosecution. The interim relief previously granted was vacated and any pending applications were ordered to be disposed of.

              PER COURT :-

              1. When the matter was called out, none appeared on
behalf of the petitioner. Perusal of the record indicates that the
present writ petition has been pending since the year 2014.

              2. Adequate opportunities have been extended to the
petitioner to prosecute the matter. As such, no purpose would be
served by keeping this matter pending.

              3. Accordingly, the present writ petition stands dismissed
              for want of prosecution.

              4. Interim relief, if any, granted earlier stands vacated.

              5. All pending applications, if any, shall stand disposed of.

                                                         (SACHIN S. DESHMUKH, J.)
