RAGHAVENDRA NARAYANRAO BHARASWADKARversusTHE STATE OF MAHARASHTRA AND ANOTHER
- Disposal
- DISPOSED OFF
Holding
The writ petitions are dismissed as the challenge has already been rejected in the earlier decision.
Summary
Sandip Dnyanoba Munde filed writ petitions (Nos. 6891, 7471, 7758) challenging a decision of the State of Maharashtra. The petitions raised the same issue that had earlier been presented in Writ Petition No. 8809 of 2026 before the Principal Seat of the High Court. The Aurangabad Bench noted that the earlier decision had already considered the matter and had rejected the challenge. The petitioner’s reliance on Tej Prakash Pathak & Others v. Rajasthan High Court (2025 (2) SCC 1) was also examined and found to have been addressed in the earlier order. Consequently, the Bench dismissed all the writ petitions.
Issues considered
- Whether the challenge raised in the writ petitions is maintainable in view of the earlier decision in Writ Petition No. 8809 of 2026
- Whether the reliance on Tej Prakash Pathak & Others v. Rajasthan High Court (2025 (2) SCC 1) provides any fresh ground for relief

[CORAM : NITIN B. SURYAWANSHI, &

DATE : 17th AUGUST, 2026
ORDER :
1. The issue raised in these petitions is squarely covered by
the decision rendered at Principal Seat in Writ Petition No. 8809
of 2026, in which the same challenge was raised and by a
detailed order, the said challenge is turned down by the

Coordinate Bench at the Principal Seat.
2. Learned Advocate for the Petitioner in Writ Petition No.
7471 of 2026, in support of his submissions, has placed reliance
on “Tej Prakash Pathak and Others V/s Rajasthan High Court and
Others” 2025 (2) SCC 1. It is pertinent to note here that in the
decision rendered at the Principal Seat, the said judgment is
already considered in paragraph No.11. We, therefore, find no
merit in the contention raised by the Petitioner.
3. For the reasons stated in the said order, the Writ Petitions
are dismissed.
