The writ petition is dismissed as withdrawn.
Summary
The petitioners, a Gram Panchayat and an activist, sought to quash a public hearing notice for a project in a Scheduled Area and to compel authorities to obtain prior informed free consent of the Gram Sabha as required by the PESA Act and the Supreme Court's Niyamgiri judgment. They also requested mandamus directing neutral venues for future hearings, inspection of effluent discharge, and a stay on construction activities. The petitioner later indicated that reliefs concerning the notice and stay were no longer required and asked that the petition be treated as withdrawn, retaining the option to file fresh proceedings if needed. The Court accepted the withdrawal of those specific reliefs and dismissed the writ petition as withdrawn, granting liberty to approach the competent authority in a new proceeding. No substantive merits on the PESA or environmental issues were adjudicated.
Issues considered
- The legality of issuing a public hearing notice for a project in a Scheduled Area without Gram Sabha consent under the PESA Act

- The appropriateness of staying the scheduled public hearing pending the petition
