MAHADEV BALASAHEB GHOLVEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is dismissed as the matter has already been concluded with an acquittal, and no further direction to register an offence can be issued.

Summary

Mahadev Balasaheb Gholve filed a criminal writ petition seeking a direction to register an offence against an intervenor for alleged misappropriation in the Loknete Gopinath Munde Backward Co-operative Spinning Mill, based on a complaint dated 16‑10‑2019. The Court’s resource personnel report dated 21‑08‑2026 revealed that an FIR had already been lodged with Kaij Police Station and regular criminal case proceedings were initiated. The Judicial Magistrate First Class, Kaij, tried the case and acquitted all accused, including the intervenor. Consequently, the Court held that there was nothing left for consideration. The petitioner’s deposit was forfeited to the Government Pleader’s Office library, and the criminal writ petition was disposed.

Issues considered

  • What is the appropriate remedy when an FIR has already been registered and the accused have been acquitted?
  • Can the High Court direct registration of a fresh offence in such circumstances?
  • Is the petitioner’s deposit liable to forfeiture upon dismissal of the petition?
