Bombay High Court

ADITYA NANDKUMAR SISODIAversusTHE STATE OF MAHARASHTRA THR. ITS SECRETARY DEPARTMENT OF HIGHER TECHNICAL EDUCATION AND ORS

Decided
Disposal
Disposed Off

Holding

The petition is covered by the Supreme Court’s protective order and therefore the writ petition is disposed.

Summary

The petitioner, a student, sought relief to appear for the 10th semester final examination despite a shortage of attendance. The High Court initially granted interim relief allowing the petitioner to fill the examination form and appear. Subsequently, the court noted that the Supreme Court’s order in Prakruthi Jain v. Bar Council of India, applied in Aniruddha Gaurav Gursal v. State of Maharashtra, provided a one‑time protection to students barred on attendance grounds for the 2025‑26 academic session. The court held that the petitioner’s case fell within the ambit of that protection. Consequently, there was no remaining issue to adjudicate, and the writ petition was disposed.
