The petition for transfer of investigation is dismissed as infructuous, while the direction for a disciplinary enquiry remains pending.
Summary
Petitioner Pooja Gaurav Jaiswal filed a criminal writ petition seeking transfer of the investigation of Crime No.251/2026 and a disciplinary enquiry against Respondent No.4. The respondent State filed an application indicating that a ‘B’ summary report had been filed on 08.08.2026. The Court held that the filing of the ‘B’ summary rendered the prayer for transfer of investigation moot, but granted the petitioner liberty to challenge the summary before the concerned magistrate. The request for a disciplinary enquiry was left open for further consideration. Consequently, the writ petition was disposed of, and the pending criminal application was also disposed.
