DURGESH KORE AND ORSversusTHE STATE OF MAHARASHTRA THR. THE DEPUTY REGISTRAR AND ORS

Decided

Disposed Off

Holding

The Court directed the Joint Registrar to decide the pending appeals within sixteen weeks, thereby granting the mandamus relief.

Summary

Durgesh Kore and others filed a writ petition seeking a mandamus directing Respondent No.2, the Joint Registrar of Co-operative Societies, to pronounce the final verdict in Appeal No. 257 of 2025 and Appeal No. 26 of 2026, which were pending before the Registrar. The petitioners argued that the delay violated their right to speedy justice. The respondents, represented by counsel for Respondent No.5, did not dispute that the appeals were pending. The Court examined whether a writ of mandamus could be issued to compel the Registrar to decide the appeals. It held that the Court could direct the authority to dispose of the pending appeals within a reasonable time. Accordingly, the Court ordered that the appeals be decided no later than sixteen weeks from the date of the order and disposed of the writ petition.
