Bombay High Court
SACHIN RAOSAHEB MASKEversusTHE STATE OF MAHARASHTRA THR SECRETARY AND OTHERS
- Disposal
- DISPOSED OFF
Holding
Because an alternate statutory remedy is available, the writ petitions are dismissed and the petitioners must pursue the appeal before the Additional Collector.
Summary
The petitioners challenged orders of Sub‑Divisional Officers who, under Sections 48(7), 48(8) and 48(9) of the Maharashtra Land Revenue Code, seized four of their vehicles that were allegedly loading sand from the Godavari riverbank. Five identical writ petitions were filed, contending that the seizures were unlawful and that the vehicles should be released. The State, through its Additional Government Pleaders, argued that the petitioners have an efficacious alternate remedy – an appeal before the Additional Collector – and cited a similar decision in Writ Petition No. 8942 of 2026. The Court held that the existence of this alternate remedy barred the writ relief and directed the petitioners to file an appeal within two weeks, depositing 25 % of the fine to obtain provisional release of the vehicles. Accordingly, all the writ petitions were disposed of without granting any relief.
Issues considered
- Whether the seizure of the petitioners' vehicles under Sections 48(7), 48(8) and 48(9) of the Maharashtra Land Revenue Code is legally valid.
- Whether a writ petition is maintainable when an alternate statutory remedy (appeal to the Additional Collector) is available.
- Whether the vehicles can be released on deposit of a portion of the imposed fine pending final determination.
