Bombay High Court
Kiran Ashok BoradeversusMunicipal Corporation of Greater Mumbai
- Decided
- Disposal
- Disposed Off
Holding
The court held that the petitioner may make a fresh application for appointment and that the Municipal Corporation must consider it in accordance with law, without being influenced by prior litigation.
Summary
The petitioner filed a writ under Article 226 seeking a mandamus directing the Municipal Corporation of Greater Mumbai to accept and objectively consider his fresh application for appointment on a preferential basis, arguing that the corporation should not reject his claim merely because his father was designated as a "Labourer" without examining the substantive duties performed. The court noted the existence of a municipal policy/circular dated 24.02.2023 that could permit such an appointment and allowed the petitioner to file the representation within two weeks. It emphasized that any decision must be made in accordance with law and should not be influenced by earlier litigation involving the petitioner. The court directed that the representation, if filed, be considered by the Designated Officer and decided within four weeks, granting the petitioner a reasonable opportunity of hearing and a reasoned order. The writ petition was thereafter disposed of without granting any interim relief.
Issues considered
- Whether the Municipal Corporation must accept and consider the petitioner's fresh application for appointment despite prior litigation.
- Whether the designation of the petitioner's father as "Labourer" can be a valid ground for rejecting the petitioner's claim.
- Whether the corporation is obligated to provide a personal hearing and a reasoned speaking order under the policy resolution dated 24.02.2023.
- Whether the corporation's decision must be insulated from the effect of earlier orders in related litigation.

2. Learned counsel for the Petitioner submits that although there is a history of
litigation in the Petitioner's case, there is, however, a policy/circular issued by the
Municipal Corporation, of which the Petitioner can take benefit. On the basis
thereof, the Petitioner intends to make an application for appointment to the
appropriate post.
3. If that be so, we permit the Petitioner to make such an
application/representation.
4. If the policy/circular permits the Petitioner to claim such appointment, such
representation/application, if made, be considered in accordance with law. All
contentions of the parties in respect of the specific case are kept open.
5. Needless to state that any decision that is taken ought not to be influenced
by the previous litigation and the orders passed in the said litigation.
6. In the event the claim of the Petitioner is not part of the subject matter of
the said proceeding, he may make an independent, fresh claim. If it is the subject
matter of earlier litigation, then we have clarified the position, as aforesaid.
7. If the application/representation is made within two weeks from today, the
same be considered and decided within four weeks thereafter by the Designated
Officer of the Municipal Corporation. Writ Petition is accordingly disposed of.
