Disposal
DISPOSED OFF

Holding

The petition is dismissed as the approval schedule has lapsed, but the petitioners are permitted to reapply in the next academic year.

Summary

The petitioners, Parvatadevi Apang Shikshan And Prashikshan Prasarak Mandal, filed a writ petition seeking approval for the commencement of new subjects in their institution. The respondents, the State of Maharashtra and others, contended that the statutory schedule for approving such proposals had already elapsed. The Court examined whether the petition could be entertained despite the closure of the government‑fixed schedule. Finding that the schedule was over and that the petition was therefore premature, the Court declined to entertain the writ. However, the Court granted the petitioners liberty to file a fresh application in the next academic year and disposed of the present petition.
